Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are an agreement between you and Prestige Worldwide Apps LLC ("we," "us") governing your use of the My Keto mobile application and the myketotracker.com website (together, "the Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service Is

My Keto is a food and health tracking tool. It uses artificial intelligence and third-party nutrition databases to estimate the nutritional content of foods you photograph, scan, describe, or search, and presents keto-focused summaries such as net carbs and "keto verdicts." It also lets you track weight, water, blood ketones, exercise, and related metrics.

3. Medical Disclaimer & Accuracy

3.1 Not medical advice

The Service provides informational content only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for the guidance of a physician or registered dietitian. Consult a qualified professional before starting a ketogenic diet or making significant dietary changes, especially if you have a medical condition, take medication, or are pregnant or nursing.

3.2 AI-generated content

Nutrition analyses, keto verdicts, micronutrient values, swap suggestions, and similar outputs are produced by AI and databases and are estimates. They may be incomplete or incorrect. Portion estimation from photographs is inherently approximate. Always verify nutrition information against product packaging when accuracy matters to you.

3.3 Your responsibility

You are responsible for your dietary decisions and for how you use the information the Service provides. Do not rely on the Service for allergen detection or for managing medical conditions.

4. Accounts

You may use the Service with an Apple, Google, or email account, or as a guest with an anonymous account. You are responsible for maintaining access to your login. Guest accounts exist only on your device until you link a login; if you lose the device before linking, your data cannot be recovered. You must be at least 13 years old to use the Service.

5. Subscriptions & Purchases

• The free tier includes a limited number of AI scans per day and core tracking features.
• My Keto Premium unlocks unlimited scans and additional features, sold as an auto-renewing subscription or one-time lifetime purchase through the Apple App Store or Google Play.
• Billing, renewal, and cancellation are handled by the app stores under their terms. Cancel anytime in your store account settings; access continues through the paid period.
• Lifetime purchases made in earlier versions of My Keto continue to be honored.
• Except where required by law, purchases are non-refundable; refund requests are handled by Apple or Google under their policies.

6. Your Content

You retain ownership of the photos, text, and data you submit. You grant us a limited license to process and store that content solely to operate the Service (for example, sending a meal photo to our AI provider to produce your analysis). We do not use your photos to train AI models.

7. Acceptable Use

You agree not to:

• Reverse engineer, scrape, or bulk-extract the Service or its databases;
• Use the Service to build a competing dataset or service;
• Submit unlawful content or content you lack rights to;
• Interfere with the operation or security of the Service;
• Circumvent scan limits, subscription checks, or other technical controls.

8. Intellectual Property

The Service, including its design, code, branding, and content we create, is owned by Prestige Worldwide Apps LLC and protected by intellectual property laws. These Terms grant you a personal, non-exclusive, non-transferable license to use the App on your devices.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY NUTRITIONAL ESTIMATE IS ACCURATE.

10. Assumption of Risk

Dietary changes carry inherent risks. By using the Service you accept those risks and agree that you use the information provided at your own discretion.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESTIGE WORLDWIDE APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms or misuse of the Service.

13. Changes to the Service or Terms

We may modify or discontinue features, and we may update these Terms. Material changes are announced in the App or by updating the effective date above. Continued use after changes constitutes acceptance.

14. Termination

You may stop using the Service and delete your account at any time in Settings. We may suspend or terminate access for violation of these Terms. Sections that by their nature survive termination (including 3, 6, and 9–12) survive.

15. Governing Law

These Terms are governed by the laws of the United States and the state in which Prestige Worldwide Apps LLC is organized, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest remain in effect. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
